What? Why? Because it has two green ovals on it? That's rediculous! I'd tell them to get stuffed, but I guess you want to keep your authentic parts priveledges.

so what are the trademark restrictions for the logo? were they mad because of the Land Rover script? or just the likeness in general with the green ovals and all?

It was the 8 that looked like 2 green ovals.

One option. Alter the 8 so both top and bottom circles. Probably the easiest, people will still recognize it and I doubt LRNA has trademarked circles.
Use a slightly different shade of green, or change the colors to black and silver.

I've no graphic skills or I'd do one.

Another option is parody, which usually allows a lot more leeway in terms of fair use. Not sure how it would apply in your case.
Keep it as is and change the upper and lower text to "Lamb Drover" ;)

A couple of the first Rovertracks test Logo's were Ovals. I was "warned" by the local dealer (friend) that LRNA would get on my case about it so I decided to go a different route.
I thought it silly that in fact aftermarket would be advertising the parent (LR) with tasteful copies of the Parent logo.
Then again try to do it with Jeep....

Has LRNA's claim to copyright on ovals ever been tested in court? It just sounds preposerous. I know, I know, who has the money for that. But, I just can't believe a couple of green coloured ovals is not allowed.

Is LRNA suing Ford now? The blue oval is only 1/2 primary colour away from green!

Without seeing their exact claim, it's hard to say. However, I would guess that their complaint comes mainly from the fact that your logo contains a green oval with "Land Rover" in an italic sans serif font. It is close enough that it could cause confusion among the less educated out there.

The yardstick typically used is what is referred to as the "moron in a hurry" test. ie could that lowest common denominator make the mistaken assumption that you're affiliated with Land Rover. To me, the answer is yes they could.

Conversely, I think you'd be fine with the logo up on your site now, where Land Rover has been replaced with "off" and "road" in the circles. But then again, I'm no lawyer.

This isn't unusual behaviour by LR. Land Rover went on the warpath in the UK several years ago and lots of companies in the UK were forced to change their identity and logo's overnight . Independent shops that been 'XYZ Land Rover Services were forced to change company name and anything containing a Land Rover logo was out. An independent LR shop near me had a Land Rover logo on their workshop service sheets. The check-sheet was for their own internal use only but somehow LR legal dept 'found out' and he was politely asked to remove the logo from all paperwork.

Only yesterday someone was telling me about a local VW custom shop that had a camper truck featured in a VW magazine. The custom shop has created a folding table that contained an inlay of the VW emblem. Cue - letter from VW legal dept reminding said custom shop that replicated the VW logo contravened their copyright!

Corporate big brother is watching you...!

I think they should realize this type of thing hurts more than it helps. They should be supporting enthusiasts of their brand, not suing them.

Not sure of the specifics of US law, but I also believe that if the trademark holder has been aware of an infringement for a significant time and not done anything about it, it dramatically weakens their chances of forcing the other party to change things later.

If LRNA have been aware of your logo, I'd be tempted to point out that they have let you build your business with that logo, fully aware of it, so it's unreasonable to try to make you change it now. You still have the option to withdraw if they continue to play hardball, so you're no worse off, I don't think.

Of course, I understand that you'd rather remain on good terms with them (although that should be a 2-way street, IMO). Also, maybe you are looking for a change anyway... :)
