Come to think of it, my argument above cuts both ways. I guess that if standing idly by, weakens the enforceablility of one's trademark, one is pretty much forced to take a harder line with any infringement, even when it's harmless, or by a business ally.

Of course the solution to that would be to grant specific permission to use the agreed infringing logo (free, or for $1/year or something), on the proviso that permission can be withdrawn at any time with reasonable notice.

Has LRNA's claim to copyright on ovals ever been tested in court? It just sounds preposerous. I know, I know, who has the money for that. But, I just can't believe a couple of green coloured ovals is not allowed.

Is LRNA suing Ford now? The blue oval is only 1/2 primary colour away from green!

Judging by Fivespddisco's avatar, I am assuming that was the logo LRNA is having a problem with.

They did quick change to what it is now, to appease LRNA for the time being.

I think they should realize this type of thing hurts more than it helps. They should be supporting enthusiasts of their brand, not suing them.

I highly doubt that this sort of thing hurts Land Rover. Same thing happen with a Ford forum. Brand loyalist will stay true to their brand.

It comes down to money, if Lucky8 licensed the logo, there wouldn't be a problem. Branding is a very serious business, some companies do not take it lightly. That is why we see Brands being sold and bought.

I agree with what you've said. Obviously have the Land Rover in the oval was a problem. But I would think that just removing the words would suffice.

My idea

So, this is kind of chicken scratch but looking at the transfer case lever on the Disco, I noticed that it resembled an '8' just by itself. I doubt that the LRNA has a trademark on a shift pattern so here is my rough idea. Its scratched out on lined paper but could be transformed into a computer drawing by someone with design skills. Its not instantly recognizable as the Rover green oval but to anyone with a Rover, it would probably instantly look familiar and yes, its the shifter out of a Disco...sorry Defender guys.

Oh, and in my all caps, doctor inspired handwriting, (1) the bottom is Lucky8's motto: Americas Largest Selection of Land Rover Aftermarket Accessories and (2) the website is written at the bottom of the knob

That was one we did a long time ago but it was close to that.
When it comes down to it is there logo and they want us not to use anything close to to because of the past issue.
L8 has some changes coming up so a new logo will work with our new direction.

One option. Alter the 8 so both top and bottom circles. Probably the easiest, people will still recognize it and I doubt LRNA has trademarked circles.
Use a slightly different shade of green, or change the colors to black and silver.

I've no graphic skills or I'd do one.

Another option is parody, which usually allows a lot more leeway in terms of fair use. Not sure how it would apply in your case.
Keep it as is and change the upper and lower text to "Lamb Drover" ;)
