That just about sums it up. Although in order to have standing to challenge a law...many times one must break that law and face the consequences.

A tactic I have a feeling was in play. In a similar southern Utah case (Canaan Mountain), the 'perp' did exactly this. The BLM was somewhat "ignoring" the use and he could have slid out of it. But he needed a ticket to fight. 3 years later they are still panning that one out
