Ya the lady NEVER answers her phone or returns my phone calls. And she always calls my work not my cell phone.

Well they dont wanna pay storage fees and offered to take it to there fee free storage. Hahaha no way. Im takin it home. An independent appraiser is come to appraise the van on sunday. Over the phone i told him the situation and he says max, i should lose 25% on the weeks old 4x4 kit so it sounds promising to have a better more accurate appraised amount. Other than that i enjoyed the rental mercedes for my vegas trip and now in a cobalt. Since thats all the insurance will pay for.

I also have a lawyer client that will represent me at no charge if it needs to go that route.

Well the independent appraiser came in, in my opinion, extremely low. I dont think they know what there looking at. They came to half what insurance offered me and thats even low. So im almost going to give up.

My last option is waiting to hear from my lawyer client and take his advice. Other than that the insurance company mailed out a check to see if id settle, and i might just do it depending on the lawyers advice.

I don't know how the laws work where you are, but in NJ I have had two vehicles totaled due to the actions of others.

In both cases I was able to negotiate at least 25% more than the insurance company's first offer and still keep the vehicles with intact, non-salvage titles. The key to the titles seemed to be the fact that both were over 15 years old. In both cases I was paid 100% of what we agreed the vehicles were worth at the time.

The main thing required of me in both cases was a paper trail to protect the appraiser's rear end. They were fine with working with me as long as I could figure out how to make it so they still looked like they were doing their job. I even faxed these docs to them for their file to support the payout decision.

I had multiple quotes on the repairs needed, and multiple replacement vehicles picked out to use as comps. It was an inconvenience, but worth it in the end.
