this is freaking crazy, im sorry but i own the effing vehicle, the moment you sold it dealer/manufacture, you lost all rights to that vehicle... its not being used to sell or promote a competitor product. what is being used is the picture I took, with my camera... i dont see Canon saying i cant sell my pictures because they were taken with their camera... when was the last time Levis said you cant use a picture with their product in it because it violates copyright infringement -if this was the case the only pictures of people would be of naked people -does Nike sue NatGeo for publishing pictures of people around the world who are wearing their[Nike] shoes!?... and i have yet to see anyone stricken dead by God for taking pictures of trees or water... ****** who died and made them king!?
The problem lies in Cafepress selling the Calendar for a profit. Your image is not the issue. Cafepress using a branded image to make a profit is. You are looking at it from the wrong side.
