First new mod is a headgasket!!!!

I posted about the Tacoma I recently bought. Seemed to be too good to be true and guess what it was!!!!!!

The price was low bluebook and these things are tough to find. The truck is in Long Beach and I am in San Diego. I had my mechanic brother who lives near the guy check out the truck and he says it is good. Alright, I'll buy it I say. Let me get a cashiers check and meet you and we can close the deal. I arrive at his house a couple days later, since he was busy the next day. He seems like and up and up guy, has a decent job, etc, etc. House, kids wife is due any minute.

Seems odd he is selling his second car while his wife is days away from delivering, and he says so himself, but Oh well.

My brother had said that when he looked at the truck there were no leaks, nothing out of the ordinary, EXCEPT the overflow coolant tank was a third low and the oil dipstick was about a third a quart low. The guy said he changed the oil 6 months ago. Also, the guy said he had the timing belt replaced and he said he would give me the receipt. He told my brother he was told that the water pump was leaking at the time but he decided not to replace it and shrugged his shoulders.

I arrive there and the guy is great, real nice etc, etc. We drive to his bank where I give him the check and he pays it off and I get the title. Along the way to the bank the truck drives nice, really nice. I notice the temp gauge needle is in the horizontal position, in the middle and ask him about it, he says it always runs there in fact when I pull a trailer it runs cooler. That sounded strange but I figured the guy was kinda of a ding bat. On the other hand he seemed intelligent. Nothing to make me cancel the deal, however.

So, I buy the truck and take it to the DMV in Costa Mesa and visit my mom. I drive the thing home to San Diego and it runs fine, really nice. I am irritated by a ding in the front windshield that is right in my line of sight. I figure if it really bugs me I can replace the glass no biggie.

I get down to San Diego and it was a long, long drive, with lots of traffic. The truck drives excellent. I get off near my home to get all the fluids changed. I drive up a small hill and the truck heats up, it heats up a lot. I was going to pull over and the Jiffy Lube is right there. I figured, heck with an oil change and coolant change that should do the trick. However, I gotta sinking feeling in my stomach.

The next day I goof with the truck and glue the shell liner thing that was loose in the back. I fire up the truck in the driveway and let it idle with the AC on, then I rev it up to 3500 rpms and try to get the engine to heat up, which it does not.

Then Sunday, I take a drive out east up towards the mountains and give her all she has, the truck runs excellent, however it is starting to heat, which it continues to do. I keep pushing until the needle gets closer towards the red. I pull her over and pop the hood and the engine is hot and some coolant is bubbling over. I sit for about 15 minutes and it cools down. I continue up the hill and the car heats again, so I fire up the heater and it keeps the temp lower.

Anyway, I drive back down the hill and figure I will take her to my mechanic. I go over to the place and the owners are there. I drop it off and leave the keys and tell them what happened.

So, I get a call and they tell me the head gasket is shot, however it is not too terrible. Overall it will cost at least $2,500 to replace the gaskets and machine the heads and new oil and water pump, thermostat, etc to make it reliable.

I called the guy that sold me the truck and it rolls to voice mail. I call again and it rings, and rings. I called again and the same. Then I just called and left a pleasant message to call me regarding the car. I figure he will not call me.

To my surprise he calls me in the evening at his house and he is really irritated sounding. I tell him what happened and he proceeds to attack me on the phone, with lots of swearing. He does not call me names, though. I am taken back. Then I realize that this is how this piece of human waste handles his unpleasant tasks. I talk calmly and logically and this guy goes all over the place. Sounded like a histerical well, you get the picture.

I tell him the price tag and ask him to pay, of course he will not, then ask to split and he will not. He says he will notify his attorney. I kinda laughed and just listened to the guy go all over the place. He accused me of 4x4ing in baja and blowing the gasket and then he said how could I know he sold me a broken car and I told him there is no way I could ever know what he was or is thinking, just that the car was broken.

I figure he is a liar and when he says the car is perfect and has never overheated is BS. Also he said he towed a bunch of stuff in the last couple weeks and the truck did not over heat up hills. He goes back and forth between this and well you bought a used car.

So, we leave it that I will be suing him and he says go ahead.

Any suggestions???

Thanks
Bill

Hi Bill,
I'm new to this forum. This is a bummer.

Caveat Emptor! (Buyer Beware!) Unfortunately I couldn't say whether you'd have any luck in small claims court. However, with material evidence like your mechanic can provide, as well as your notes, the odds might be better than 50-50.
The seller obviously went on the defensive with his attack, indicating he is willing to continue to lie. This lying sack of baloney has had plenty of practice, yet these blow hards usually underestimate, and photographic evidence and a statement from the mechanic could very well catch this guy off guard, and delight the judge!

Most would walk away. I've been a victim as well, but chalked it up to just another random and unfortunate event. There is no way you could have known. The truck could have blown the gasket two months later. One must consider the emotional stress of facing the ordeal. In my case I left the state and returned home to Montana!!

Good Luck,
Erick

I am sorry to hear about your problem, however I am not sure of your legal rights in the state of California, you may check with your area attorney and find the legal rights you may have before you continue to file a small claim!

Here in the state of Texas you buy as is!

Best of luck!

Sorry to hear about the situation--what a bummer!

I agree with the previous poster, most states are pretty explicit with "buyer beware" laws, unless you're buying from a licensed dealer. Check your bill of sale, if it says "as-is" I think you're pretty well screwed.

That being said, I'm not familiar with California law, and god knows they have some strange ones, so you never know. Ultimately you will have to explain to a judge why you didn't take the truck to a mechanic for a thorough pre-purchase inspection that would have cost $100-$200 bucks, and that will be a hard question for you to answer......

If the mechanic is able to prove that the h-gasket has been bad for some time, maybe some well-planned revenge is your only solution.....

Good luck man, I've had my share of rip-offs too, so I "feel your pain" (I didn't inhale either......lol)

what motor? The 3.0 has a recall for head gaskets and you might be able to get it under warranty.
I think it's a '02 DoubleCab Taco, so this is the 5VZ-FE V6. Not known for such problems, particularly at only a few years old.

Thanks guys. I did have my mechanic brother look at it, but he did not perform any of the tests that could have determined a blown head gasket.

The head gasket was only recently blown and not blown very bad, so it is or was impossible to determine just by driving it and looking out the tail pipe.

My bill of sale did not have as is, but you may be right as far as that may be how things are with a private individual.

So, before I go through with this I need to check.

You cannot trust anyone when it comes to buying a car. In three used cars from individuals in 22 years I have gotten screwed royally each time, you know you would have thought I would learn. This truck was really, really priced low and even with a $2,500 repair bill off the bat, I am still ahead, assuming no other problems. The truck otherwise is solid and really in good shape.

I have bought another three cars used at a new car dealer and each one of those cars has been great. You pay more at a dealer for a used car, but you get piece of mind.

You can do chemical tests to determine if you have a blown head in the early stages.

Thanks again
Bill

Yeah, I don't know California law but seeing as how you bought a 5 year old vehicle with 90k on it, I think you're going to have a tough time proving that the seller defrauded you. If you can find the shop where he took it and get the mechanic to testify (or write a statement) that he told the previous owner the HG was blown, then you might be able to recover some of your damages, but by the time you invest a lot of time doing this, it might come out as a wash anyway. It also depends on what the laws of California say about sales of used vehicles by private individuals.

Here's another way to look at it, though: Add in the cost of repair and that takes you to - what, $16,500? So, would you have paid $16,500 for that vehicle, knowing that it had a good engine and head gaskets? If so, (and I think you said this was the case) then you are in the same position you would have been in had the previous owner done the HG himself and added it to the price. Better, in fact, because some warranties aren't transferable, but in this case, since you're having the work done, you don't have to worry about it - the repair warranty will be in your name.

Forget the ski mask. I prefer for those who get a beating from me to know it was me. This way they will never put themselves in a position to get another beating.....from me atleast.

On a side note just get it fixed and move on. Lesson learned. In this situation there is little that anyone can due to prove he didn't know about the issue being as severe as it ended up. Sorry for the bad deal but but save yourself the frustration and just make the repairs. Then treat yourself to a nice baja adventure to celebrate your truck while he hopefully is crashing off a cliff in his new whatever.
